www.hongkongai.org (the “Site”) is a website of Hong Kong AI & Data Laboratory Limited (“HKAI LAB”, “we,” “us,” etc.), established for the purpose of bringing together academics, scientists, and entrepreneurs in artificial intelligence (“AI”) who are passionate about innovation and creating a better future. HKAI LAB is a not-for-profit initiative and it is fully funded by the Alibaba Hong Kong Entrepreneurs Fund and SenseTime, with support from the Hong Kong Science and Technology Parks Corporation (“HKSTP”), Alibaba Cloud and the Alibaba DAMO Academy.
This Privacy Policy informs you how your information is collected, stored, and used by us when you use services offered by our Site (“Services”). By using our Services, you understand and agree that we may collect, store, and use your information in accordance with this Privacy Policy.
This Privacy Policy is incorporated into the HKAI LAB (“Disclaimers”) by reference. Any terms used in this Privacy Policy will have the same meanings as those in the Disclaimers unless otherwise specified. This Privacy Policy only applies to the information collected, stored, and used from our Services by us, and does not apply to information collected through any third party services that you may access through our Services.
You acknowledge and agree that you can only participate in any of our events or other events registered through the Site (“Event”) if you accept the terms of this Privacy Policy. By submitting your application or participating in the Event you agree to be bound by and accept the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, you must not submit your application or participate in the Event.
For the avoidance of doubt, any reference to “HKAI LAB” in the following paragraphs in this Privacy Policy shall be read as “HKAI LAB and its affiliates”.
1. THE INFORMATION WE COLLECT
Your privacy is important to us and we have taken steps to ensure that we do not collect more information from you than is necessary for us to provide our Services to you.
When you submit an application to the “Accelerator Program”, you may provide us information such as your name and email (“Personal Information”). When you submit an inquiry or application to our programs, you may also provide us content such as your proposal, resume, and comments (“User Generated Content”).
We record and retain records of browsing activities on our Site including but not limited to your IP addresses and browsing patterns. In addition, we gather statistical information about the Site and visitors to the Site including, but not limited to, IP addresses, browser software, operating system, software and hardware attributes, pages viewed, number of sessions and unique visitors (collectively, “Browsing Information”).
For the purposes of this Policy, Personal Data refers to Personal Information, User Generated Content, Browsing Information, and any other user related information.
2. HOW WE USE YOUR INFORMATION
We shall use your personal data in accordance with the personal information collection statement provided by us to you on or before the time of collection of your personal data. Such use may include: we may use your information we collect to pursue our mission and operations and to engage in the activity and related activities for which we collect it. Specifically, we may use your Personal Data: to fulfill our obligations to you and to respond to any questions or requests from you; to contact you about material changes in our Site, terms or policies; to comply with the applicable law(s) or in good faith belief that such action is necessary to conform with the requirements of applicable law(s) or to comply with legal process served on us; to provide to third parties as a result of any reorganization process; if you apply for an investment program or a placement program, we will use your Personal Information and User Generated Content you provide to find out about you and share it with service providers and other third parties we view as relevant to the program for which you are applying.
3. COOKIES
Web pages on this Site may contain cookies or related technology to facilitate your experience with the Site. Cookies are text files placed in your computer's Internet browser to store your preferences. Cookies do not provide your email address or other personally identifiable information. We may also collect information on which web pages you visited or other actions you take while on our Site. We only obtain this information when you choose to provide it to the Site. You may disable cookies in your browser. However, certain functionalities of this Site that depend on cookies may not work if cookies are disabled.
4. YOUR RIGHT TO OPT OUT
You understand that we may use the information you provide to us to send emails and newsletters to you. If you no longer wish to receive these communications, you can do so by following the instructions to unsubscribe set forth in our communication we send to you, or contact us.
5. THE INFORMATION WE DO NOT INTEND TO COLLECT
(1) Some Personal Data such as your mental health condition, sexual orientation, medical history, or criminal record is considered “sensitive” in some jurisdictions, and is subject to heightened regulation than the other types of Personal Data. We do not intend to collect such sensitive Personal Data from you and any such sharing of sensitive Personal Data is entirely at your own sole discretion and risk.
(2) We do not intend to collect Personal Data from children under the ages of thirteen (13). Please contact us if you believe that we may have Personal Data from children under the ages of thirteen (13), and we will investigate promptly and remove such information upon confirmation.
(3) Do not supply Personal Data about others unless you are authorized or required to do so by applicable law or contract and you consent to the Disclaimers and this Privacy Policy on behalf of yourself and the person(s) about whom you supply Personal Data (“Data Subject”). Before supplying Personal Data about others (except as otherwise allowed by law or contract), you must make available for the Data Subject’s review, and obtain their written consent to, said Disclaimers and Privacy Policy. By submitting any Personal Data about others, you represent and warrant that you are authorized to do so and that you did all of the foregoing before submitting the information. If applicable law allows you to supply the information without doing the foregoing, you represent and warrant that you have abided by such applicable law and that it allows us to receive and disclose the information under this Policy without any further action on our part. You agree to indemnify, defend and hold us harmless against any failure by you to comply with this paragraph.
6. YOUR PARTICULAR CONSENT
You are giving us the following particular express, voluntary, and informed consent to a few activities relating to your Personal Data that is disclosed in furtherance of our mission and operations, or for a purpose directly related to such purpose:
(1) Consent to International Transfer and Disclosure of Personal Information: We are involved in programs and activities in a variety of countries. You agree that the Foundation and those with whom we share your Personal Data (“Recipients”) may disclose and transfer your Personal Data worldwide to our affiliates, sponsors and partners, and any other third party service providers for any purpose to further our mission and operations.
(2) Consent to Electronic Notice If There is a Security Breach: We will safeguard your Personal Data and prevent such information from unauthorized access, disclosure, or use. If we or a Recipient is required to provide notice of unauthorized access to or other invasion of certain security systems, you agree that we (or they) may do so when required (or voluntarily) by posting notice on our Site or sending notice to any email address we have for you, in our (or their) good faith discretion. You agree that notice to you will count as notice to others for whom you are acting, and agree to pass the notice on to them.
(3) Media Consent: You provide the following consent to HKAI LAB, its business partners (e.g. HKSTP) and sub-licensees to take photos, digital images, audio and/or video footages of you, and to use your Image (defined below) in any form of media for the purpose of promoting HKAI LAB, Venture Hours and/or Hong Kong entrepreneurship. The term “Image” refers to the full set of attributes of your personality, including but not limited to your image, voice, family name and forenames, signature and business name / logo. You grant HKAI LAB an exclusive, worldwide, perpetual, irrevocable, unrestricted, royalty-free, assignable, transferable and fully sub-licensable license to all present and future rights, title and interest in all intellectual property (including, without limitation, any trademark, copyright, publicity, and database rights, and the right to prepare derivative works) you have in your Image, to store use, reuse, edit, modify adapt, reproduce, display, host, publish, circulate, or distribute your Image as HKAI LAB deems appropriate in its sole and absolute discretion. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights. HKAI LAB is not obligated to submit any promotional and other materials to you, or your organization for approval, or to produce, distribute or utilize any of the rights granted herein. You irrevocably and unconditionally waive any and all moral and similar rights vesting in your Image to the extent legally permissible.
7. RETENTION PERIOD
(1) We keep Personal Data for as long as we think is necessary or advisable and we reserve the right to retain it to the full extent not prohibited by law. We may discard Personal Data in our discretion, so you should retain your own records, and not rely upon our storage of any Personal Data, content, or other data.
(2) Subject to applicable laws and regulations, you may have the right to inquire and request for a review of, request a copy of, make supplements or corrections to, discontinue collection, processing or use of, or request to delete some or all of your Personal Data at our possession. Please contact us if you have any inquiries as to what information we have concerning you, and submit your new information if your Personal Data has changed.
8. CHANGES TO THIS PRIVACY POLICY
We may revise this Privacy Policy from time to time to reflect changes in our Services, in accordance with customer feedback or for any other purposes. We encourage you to review our Privacy Policy periodically to be informed of how we collect, store and use your information. Where we consider any changes to this Privacy Policy reasonably material, we will notify you prior to such changes becoming effective (via email or any other means). You agree that by continuing to use our Services, without or without notice from us, you consent to the changes to this Privacy Policy.
9. ENGLISH VERSION PREVAILS
In the event of any discrepancy between the English version and the Chinese version of these Disclaimers, the English version shall prevail.
10. MISCELLANEOUS
This Privacy Policy contains the entire agreement between HKAI LAB and you concerning this subject matter. The laws of Hong Kong will govern this Privacy Policy, except for the body of law relating to conflicts of law and the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute that arises out of or in connection with this agreement.
